MissionHand Acceptable Use Policy (AUP)

Purpose and Scope
This Acceptable Use Policy ("AUP") sets out the rules for using MissionHand, the nonprofit operations platform provided by Serve by Design, LLC. It applies to all Customers (the nonprofit organizations that subscribe to MissionHand) and all Authorized Users (staff, volunteers, and contractors who access MissionHand under a Customer's account).
This AUP is incorporated into and forms part of the MissionHand Terms of Service. Words defined in the Terms of Service have the same meaning here.
The goal of this AUP is simple: use MissionHand lawfully and in good faith to serve your nonprofit's mission. Don't use it to harm others, misuse others' data, or compromise the platform for other users.
1. Permitted Uses
MissionHand is designed and licensed for.
- Managing your nonprofit organization's internal donor records, donation tracking, and acknowledgment.
- Case management and tracking services for beneficiaries and clients of your organization.
- Volunteer recruitment, scheduling, and management.
- Internal staff scheduling and communications.
- Sending communications (email) to your organization's donors, volunteers, and beneficiaries who have consented to receive communications from you.
- Building and managing a public website for your nonprofit using the MissionHand website builder.
2. Prohibited Uses
You may not use MissionHand to.
2.1 Illegal and Unauthorized Activity
- Violate any applicable law, regulation, court order, or government directive, including US federal law, Florida law, and the laws of any other jurisdiction whose residents' data you process.
- Engage in, facilitate, or enable any activity that constitutes a crime, including fraud, identity theft, money laundering, or unauthorized financial transactions.
- Operate MissionHand in a manner that causes harm to individuals whose data is stored on the platform.
2.2 Misuse of Personal Data
- Process personal data of donors, beneficiaries, or volunteers for any purpose other than the lawful activities of your nonprofit organization.
- Collect personal data in MissionHand without a lawful basis to do so under applicable law.
- Enter personal data into MissionHand in violation of applicable privacy law, including without providing required notices to the individuals whose data you collect.
- Use MissionHand to build profiles of individuals for purposes unrelated to your nonprofit's charitable mission.
- Sell, rent, or disclose the personal data of your donors, beneficiaries, or volunteers to third parties for those parties' own marketing or commercial purposes.
- Access or attempt to access another organization's data within MissionHand.
2.3 Harmful, Abusive, or Harassing Communications
- Send unsolicited commercial electronic communications ("spam") to any person who has not consented to receive communications from your organization. All email campaigns sent through MissionHand must comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.) and any applicable state laws.
- Send communications that are defamatory, harassing, threatening, or abusive.
- Use MissionHand to send communications that discriminate against any person on the basis of race, color, religion, sex, national origin, disability, or other protected characteristic.
2.4 Security and System Integrity
- Interfere with or disrupt MissionHand's infrastructure, servers, or networks, including by launching denial-of-service attacks, port scans, or network probing.
- Introduce malicious code, viruses, Trojan horses, worms, or any other harmful software into MissionHand.
- Attempt to gain unauthorized access to any portion of MissionHand, including another customer's data or our backend systems.
- Use automated tools (bots, scrapers) to access MissionHand in a manner that places an unreasonable burden on our infrastructure.
- Circumvent, disable, or interfere with security features, including access controls or encryption.
- Attempt to reverse engineer, decompile, or disassemble any part of MissionHand.
2.5 Misrepresentation
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Falsely represent that you are authorized to enter data about individuals into MissionHand when you are not.
- Create fraudulent accounts or accounts for any purpose other than legitimate nonprofit operations management.
2.6 Intellectual Property
- Upload, post, or transmit any content that infringes the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party.
- Reproduce or distribute any portion of MissionHand's code, design, or documentation without our express written consent.
2.7 Regulated Activities Requiring Additional Agreements
- Use MissionHand to store or process health information subject to the Health Insurance Portability and Accountability Act (HIPAA) without first executing a Business Associate Agreement with Serve by Design. If your organization operates a HIPAA-covered healthcare component, contact us at info@servecustom.com before using MissionHand for protected health information.
- Use MissionHand as a payment processor, money transmitter, or financial institution. MissionHand facilitates donation payment processing by connecting to the nonprofit's own Stripe or PayPal account; MissionHand itself is not a payment processor or money transmitter.
3. Content Standards
Content you upload to or generate through MissionHand (including case notes, communications, website content, and attached documents) must.
- Be accurate and not misleading.
- Not contain material that is obscene, pornographic, or sexually explicit.
- Not contain material that promotes violence or terrorism.
- Not contain material that a reasonable person would consider to be hateful or discriminatory toward any group of people.
- Not infringe the intellectual property rights of third parties.
- Not violate any applicable law.
4. Your Responsibility for Authorized Users
You are responsible for ensuring that all of your Authorized Users comply with this AUP. You must.
- Provide your Authorized Users with access only to the data and features they need to perform their roles.
- Promptly revoke access for any Authorized User who leaves your organization or whose role no longer requires access.
- Notify us immediately at info@servecustom.com if you become aware of any AUP violation by an Authorized User or any unauthorized access to your account.
5. Reporting Violations
If you become aware of a potential AUP violation — whether by another customer or by an individual using a nonprofit's MissionHand account — please report it to us at info@servecustom.com. We take reports seriously and will investigate.
6. Consequences of Violations
If we determine that you or an Authorized User has violated this AUP, we may take any of the following actions, depending on the severity of the violation.
- Issue a warning.
- Temporarily suspend access to MissionHand.
- Permanently terminate your subscription without refund.
- Remove or disable offending content.
- Report the violation to law enforcement or regulatory authorities if required or appropriate.
We will generally provide notice and an opportunity to cure before suspending or terminating your account, unless the violation is severe, immediate, or an emergency (such as an active security incident, immediate harm to individuals, or serious legal risk).
7. Compliance with Law
This AUP does not create legal compliance obligations beyond what already apply to you under applicable law. You remain solely responsible for complying with all laws governing your use of MissionHand, including privacy laws, charitable solicitation laws, employment laws, and sector-specific regulations applicable to your nonprofit.
8. Changes to This AUP
We may update this AUP from time to time, with the same notice requirements as the Terms of Service. Material changes will be communicated at least 30 days in advance. Continued use of MissionHand after an updated AUP takes effect constitutes acceptance.
